Oil Tank Abandonment in Place

Abandonment in place means emptying and cleaning a buried tank and filling it with an inert material instead of digging it out. It can make sense when a tank sits under a structure. Lenders treat a properly closed tank differently from one simply left in the ground; an abandoned tank and a properly closed tank "are not necessarily the same thing"1.

Removal vs abandonment

  • Removal lets soil under the tank be inspected directly.
  • Abandonment avoids excavation but leaves the tank in place for future buyers to ask about.
  • Either way, keep documentation; lenders may request a closure certificate or contractor report1.

FAQ

Does PA DEP require me to remove my home heating oil tank?

No. Tanks storing heating oil burned on the premises are excluded from the state program, and DEP says home heating oil tanks are not regulated2,3. Owners usually act because of a sale, a lender, an insurer, or leak risk.

Can I sell a house with a buried oil tank in PA?

State law doesn't prohibit it, but you must disclose known material defects4, and the buyer's lender may require inspection or documentation5,1.
