Who Pays for Oil Tank Removal: Buyer or Seller?
Short answer: No Pennsylvania rule assigns the cost. Pennsylvania's storage tank law doesn't regulate most home heating oil tanks used on the premises: tanks storing heating oil for use where it is stored are excluded, and DEP lists home heating oil tanks as not regulated1,2. Local rules, lenders and buyers may still require action, such as a permit, testing or removal before a sale. Beyond that, it's a negotiation between buyer and seller. The seller must disclose known material defects3, and the buyer's appraiser and lender may require inspection or closure paperwork4,5. That pressure is why sellers often handle it before listing or offer a credit.
Common ways it gets settled
| Approach | How it works | Watch for |
|---|---|---|
| Seller removes before listing | Seller hands over removal and soil reports | Strongest paperwork for the buyer's lender5 |
| Seller removes before closing | Work done during the contract period | Book early; lender conditions found late can stall closing |
| Credit or price reduction | Buyer handles it after closing | Lender may still require closure documentation first5 |
| Buyer pays for a sweep | Buyer checks for an unknown tank | $250–$500 per one Philadelphia source6 |
What each side should ask
- Buyer: Is there a current or past oil tank? Any removal, abandonment or soil-test reports5?
- Seller: What do I know that belongs on the disclosure statement3? Do I have the paperwork a lender may ask for5?

FAQ
Does PA DEP require me to remove my home heating oil tank?
No. Owners usually act because of a sale, a lender, an insurer, or leak risk.
Does the seller have to disclose an oil tank?
Pennsylvania sellers must disclose known material defects on the property disclosure statement3. Ask your broker or attorney how that applies to a particular tank.
